Terms and Conditions

1) The applicant shall be liable to the City of Vienna, the Republic of Austria and all in the course of the shootings affected public institutions and private institutions accessible to the public (in the following called "the institutions") for all out of the shootings resulting damage or other disadvantages and is obliged to compensation of the resulting damage or other disadvantages. The entire shootings, as well as all related measures and actions will be performed at risk of the applicant only. The applicant shall indemnify the institutions against all claims of third parties (personal injuries and/or damage of property) if these claims are based on or caused by the shootings.
2) The shootings must cause no, respectively the least possible, disturbance in the functioning and/or operation of public services, offices or institutions. The shooting location may only be used for authorized shootings.
3) A binding commitment to realization of the shootings at the desired time and at the desired shooting location, especially a binding commitment that operating requirements of the institutions do not prevent the realization of the shootings, is not provided by the letter of recommendation which the applicant will receive from the Vienna Film Commission; obstacles may be possible in individual cases. Instructions given by the public supervisor/s must be complied with at all times.
4) The letter of recommendation by the Vienna Film Commission is valid only for outdoor shootings. Shootings inside of buildings are to be expressively authorized. Shootings may only be carried out by the use of portable equipment and without the use of vehicles.
5) Facilities and open areas may not be driven on with vehicles; traffic, public transport and pedestrians shall not be obstructed. Traffic areas and paths outside the area of the shooting location shall not be obstructed in a way that an appropriate use is made impossible. This letter of recommendation does not contain access road authorization.
6) Any soiling or dirt of the shooting location (shooting area) and the surrounding area shall be avoided or has to be removed by the applicant without delay.
7) Any undue inconvenience (including noise nuisance) of residents, patients, tenants or third persons shall be avoided.
8) This letter of recommendation can only be used for shootings on public traffic areas and/or areas of the named institutions. Footage of private scenes has to be approved by the respective owner.
9) This letter of recommendation shall be used only for shootings relevant for reporting before and about the ESC 2015. Any other use of the footage requires the explicit agreement of the respective institutions.
10) In case of any disputes arising out of or in connection with these general terms and conditions with the institutions, for which special jurisdiction is not explicitly determined by legal provisions, the competent courts in 1010 Vienna have jurisdiction. These general terms and conditions shall be subject to Austrian law excluding the conflict-of-law-rules of international private law.
